Accused MySpace Mom Splashed With Juror Venom

Jury selection for the trial of Lori Drew, the Missouri woman accused of illegally creating a fictitious MySpace profile (one that resulted in a fragile 13-year-old girl committing suicide) was supposed to race by today; there was even talk of opening statements being heard late this afternoon. Nothing doing, however – those Tuesday statements were as much a mirage as the “Josh Evans” character that Drew is accused of cooking up in cyberspace to torment the late Megan Meier. Instead, delay piled on delay and voir dire, the process by which potential jurors are questioned by judge and attorneys, didn’t even start until after 4 p.m.

“Did anyone see Suspect?” asked Federal Judge George Wu, addressing a new batch of possible jurors. “It came out about 10 years ago with Cher . . . Liam Neeson and Randy Quaid. You know it was fiction because Cher played an attorney.”

U.S Attorney Thomas O’Brien and Drew’s lawyer, Dean Steward, sat stone-faced. They were not playing at being attorneys, but were seeing the day slip away as the cinephile judge warned jurors not to investigate the case the way Randy Quaid had in a 1987 movie.

The matronly Drew, who faces four felony counts, also sat stoically. It’s not known if she reminds Wu of any movie actresses – perhaps Shelley Winters in mid-career – but her attorney, Steward, let it be known outside the presence of prospective jurors that a good majority of the latter had heard of the MySpace case and “50 percent or more have formed devastating opinions.”

These ranged, said Steward, looking at some of the juror questionnaires that had come back, from the venomous to the vicious.

“They’re convinced my client is guilty and must be punished.”

Steward said he was not yet at the point of asking for a mistrial (Judge Wu, after all, hasn’t gotten up to Primal Fear yet), but did ask once more that whatever jury is impaneled not have to hear the words “suicide” and “death” during testimony. Steward’s suggestion – which had already been rejected by Wu last Friday -- was predictably batted down by O’Brien, so the defense attorney settled for Wu removing the six potential jurors whom Steward described “as the ones that drip with the most venom for my client.”

Jurors were informed that the trial should take five days, ending on November 24, yet Day One probably won’t start until tomorrow, making that forecast an improbability. There is, after all, so much venom to be vetted.

MySpace Japan bets on world demand for J-Pop

TOKYO (Reuters) - Banking on the global appeal of Japanese pop and video games, social networking site MySpace said it would more than double the number of artists on its Japanese pages to get more clicks internationally.

The growth of new sign-ups and page views is slowing in Japan for rival networking services such as mixi Inc, but Myspace, which launched its Japanese site two years ago, aims to buck the trend by expanding the range of sales artists can make on its site.

This, allied with growing interest in J-Pop music and Japanese video games in other parts of the world, will help the site grow rapidly, said the Japanese head of MySpace, which is owned by Rupert Murdoch's News Corp.

"Until now, Japanese artists catered primarily to the home market, but the home market is no longer big enough," MySpace Japan CEO Atsushi Taira said in an interview with Reuters. "Demand for Japanese music and games is strong abroad, and we are now uniquely positioned to clear barriers posed by language."

The number of artists that have registered with the Japanese version of MySpace has doubled in the last six months to a little under 90,000 people, Taira said.

"I think we can easily double that in a year's time," as more artists use MySpace to sell their music and T-shirts next year, he said. "Once we have a large group of artists using MySpace, the content will win more fans and other users."

MySpace recently went into business with music labels such as Sony BMG Music, Universal Music Group and Warner Music Group that allows users of the website to stream and download music, grab ringtones and buy concert tickets.

The service will be available in Japanese next year.

Popularity of social networking sites is waning in Japan, where they are often used to reinforce existing friendships, rather than to expand networks, according to market research firm Synovate, which conducted a poll in October that found 55 percent of Japanese users saying they were losing interest.

Jennifer Hudson Thanks Her Fans on MySpace


Oscar winner Jennifer Hudson has been in seclusion, mourning the shocking murders of her mother, brother, and young nephew. But the singer and actress recently posted a message on her MySpace page, thanking fans for their support. "I want to thank each and every one of you for your thoughts and prayers during this difficult time," Hudson wrote late last week. "My sister and I take great comfort and strength from your love and concern."

Hudson has also given the go-ahead to clothing retailer The Gap to use her image in a celebrity-driven holiday ad campaign. The Secret Life Of Bees star was given the option to back out, said company rep Olive Doyne. "She said she wanted to be a part of it and that we should move forward," Doyne said.

Hudson was photographed for the Shine Your Own Star campaign back in July in New York City. Her image, a playful shot in a red sweater, will be seen in magazines and newspapers and on billboards in New York and Los Angeles.

Meanwhile, the investigation into the killings is ongoing. Her estranged brother-in-law, William Balfour, considered a person of interest in the case, remains in custody until December 3rd on a parole violation.

All proceeds from download sales will help fund the Shriners Hospitals for Children, which provide free care to children with orthopedic conditions, burns, spinal cord injuries and cleft lip and palate.

“Follow My Lead,” featuring Esmée Denters, was recorded live at Timberlake’s recent Justin Timberlake and Friends Shriners benefit concert, which brought together 50 Cent, Adam Levine of Maroon 5, Boyz II Men, Leona Lewis, Lionel Richie, Rihanna, The Jonas Brothers and Will.i.am. Footage from that show is also available for viewing on Timberlake’s MySpace page.

The song will be available to purchase on MySpace exclusively for the next three months.

Jury Selection Begins in MySpace Suicide Trial

LOS ANGELES -- Jury selection began Tuesday in the trial of a Missouri woman accused of making unauthorized use of MySpace to cause emotional harm to a 13-year-old girl.
Forty-nine-year-old Lori Drew of O'Fallon, Missouri is charged with one count of conspiracy and three counts of unauthorized computer access for allegedly creating a fake MySpace account to inflict intentional emotional distress on a teenage girl, Megan Meir, who then committed suicide in 2006.
Drew -- in a casual green blouse and pants, a white sweater and brown leather slip-on shoes -- appeared relaxed as the jury selection commenced Tuesday morning. She sat beside her attorney, H. Dean Steward.
The trial marks the first federal criminal case to arise from a user's alleged violation of website's terms-of-service, and critics of the prosecution say it could have dangerous implications for internet users -- potentially setting a precedent for charging users with felonies for violating often-abusive click-wrap contracts.
According to prosecutors, the case began in 2006, when Drew allegedly conspired with two others in creating and maintaining a MySpace profile for a nonexistent 16-year-old boy named "Josh Evans." The Evans account was used to flirt with and befriend Meier, who'd had a falling-out with Drew's daughter.
The fake "Josh" ultimately turned on Meier, and told the girl that the world would be a better place without her. Meier already suffered from clinical depression, and shortly after that final message she hanged herself in her bedroom.
The case against Drew hinges on a novel interpretation of the federal Computer Fraud and Abuse Act. MySpace's user agreement requires registrants, among other things, to provide factual information about themselves; to refrain from soliciting personal information from minors; and forbids members from using information obtained from MySpace services to harass or harm other people. By allegedly violating that click-to-agree contract, Drew committed the same crime as any hacker, prosecutors maintain.
The use of the anti-hacking law to charge Drew was criticized by experts who said it set a dangerous precedent that could potentially make a felon out of anyone who violated the terms of service of any website -- a prospect that is particularly troubling, they said, because terms-of-service agreements sometimes contain onerous provisions, are often arbitrarily and unilaterally changed by companies, and are rarely read by users.
Drew has pleaded not guilty to all of the charges and has maintained that she didn't write the messages that were sent to Meier. A young employee of Drew has admitted that she sent the final message that Meier received
Meier and the Drew's daughter were reportedly friends for many years, but had a rocky relationship.

According to the government's account, during the summer of 2006 the relationship between the two girls had deteriorated to such a state that Drew became concerned that Meier was spreading malicious rumors about her daughter. After discussing the concerns with her daughter and Ashley Grills, a then-18-year-old girl employed by the Drews, the three conceived a plan to create the fake MySpace account.
The fake Josh Evans account was created on September 20, 2006. Evans was presented as a lonely boy whose father had abandoned his family. He claimed he was new to the area and was home-schooled. The same day the account was created, "Evans" contacted Meier through MySpace seeking permission to correspond with her.
According to court documents, the communications were innocent at first. But a few days later, Drew allegedly encouraged her co-conspirators to flirt with Meier. She also allegedly discussed a plan to humiliate Meier in person by luring her to a mall under the guise of meeting Evans, at which point the conspirators would tell Meier that Evans never existed and taunt the girl with information she had exchanged with the fake boy.
During this time, Drew allegedly discussed the scheme with her hairdresser and a business contact, telling them that she and others were playing a joke on Meier. When her confidants expressed concerns about the stunt, she allegedly dismissed them as unfounded.
On October 15, 2006, another unnamed girl in the neighborhood obtained the username and password for the Evans account and sent Meier a message saying he no longer wanted to be friends with her. The next day, October 16, Grills, posing as Evans, wrote Meier that the world would be a better place without her in it.
Megan Meier hanged herself in her closet. She was transported to St. Joseph's hospital, then shortly thereafter to SSM Cardinal Glennon Children's Hospital in St. Louis, where she died.
After learning what had happened, Drew and her husband allegedly instructed her co-conspirators to delete the Josh Evans account, and Drew deleted evidence of the hoax from her computer. She also allegedly called the neighborhood girl who had written the October 15 message and told her to "keep her mouth shut" and keep out of MySpace.
Six weeks after Megan's death, Tina and Ron Meier learned about the hoax from a neighbor. The Meiers had been holding a foosball table for the Drews, and they destroyed the table and dumped it on the Drews' lawn.
On November 25, 2006, Drew contacted the St. Charles Sheriff's Department to discuss heightened tension between the two families. During her discussion with the deputy, Drew allegedly admitted that she instigated the MySpace account, and that, along with Grills and her own daughter, she had typed, read and monitored the conversations with Meier, which "became sexual for a 13-year-old."
When FBI agents later interviewed her, she claimed she wasn't involved in the scheme.
The government will likely paint a picture of Meier's mental health history, which included prescription medication, and attempt to prove that Drew was aware of the teen's fragile emotional state.
According to records filed by prosecutors, the Drew and Meier families had been friendly for several years, and Megan Meier even took trips with the Drews. During one trip, the defendant administered Megan's prescription medication to her. Additionally, Meier's mother, Tina, confided in Drew about her daughter's mental health and emotional vulnerability.
The defense will likely try to show that Meier's mental health history played more of a role in her death than the defendant's actions. According to documents filed by the defense, Meier may have suffered from clinical depression and Attention Deficit Disorder, and had tried to commit suicide at least once prior to October 2006. The defense counsel also subpoenaed medical records from two hospitals where Meier was taken after she hanged herself.
