Three years and $300000 doesn't seem like enough punishment for a 49-year-old woman who made a fake Myspace with her daughter in order to manipulate and torment their emotionally fragile neighbor, coaxing her into suicide. However, that's as tough as the penalty gets because the jury knocked down felony charges and only convicted her of three misdemeanor counts of computer fraud.

The tech industry worries that if this verdict of "computer fraud" stands, it could mean that every site on the internet would be able to define the criminal law. Those small-stakes contracts members fill out (usually without reading) before joining any website may suddenly become high-stakes criminal prohibitions.

This could definitely be a big change, and likely not a good one either. So the balance of how to punish the bully without setting an unwanted precedent is tough.

What the jury should have done is drop the computer fraud charges and throw her in jail with a felony. Not allowing post-menopausal women to terrorize the neighborhood children seems like a verdict that certainly wouldn't hurt our way of life.

It seems wrong to make for a more difficult relationship between law and the internet just because of this one woman's actions, and yet it seems horrible to think of this same woman to be allowed to just go home without penalty after her actions have cost another mother to lose her daughter.

This is the latest edition of my look at social networks and their populations from a marketing perspective. All numbers in this post are US-only and are collected using each site's advertising management systems so they are up to date and accurate from a marketer's perspective. (Who wants to talk about populations that can't be reached by marketing? Not me.)

There were some surprising shifts in the population of MySpace this month. Of note:

30.32% drop in the 14-17 age group (October-November)

32.93% gain in the 41-45 age group

40.65% gain in the 46-65+ age group

Facebook, by comparison had fairly consistent gains across all age groups. Increases ranged from 26.30% to 30.86%.

Mega rap star Kanye West has decided to link up with MySpace Music to give fans the opportunity to hear his entire new album 808s & Heartbreak three days before it hits stores.

Beginning today (November 21), the hitmaking producer-turned-rapper will exclusively give MySpace users the chance to hear additional cuts from the disc along with his smash singles "Heartless," "Coldest Winter" and "Love Lockdown."

Logging on to the MySpace music section, users will hear the project from start to finish while also having the ability to check out Ye's own MySpace page featuring additional music, videos and other gadgets.

Researchers from the Children’s Digital Media Center, Los Angeles, asked 23 ethnically diverse undergraduate students who were active MySpace users to participate in focus groups. They were asked a variety of questions, including what they liked and disliked about MySpace, if they felt that people used their profiles to present themselves a certain way, why these chose specific pictures, and if people represented themselves in a realistic light.


Responses were recorded and analyzed; the following comment was used to show how, according to the study, "social comparison can help emerging adults realize how they wish (or do not wish) to progress into adulthood": "I look at MySpace and I see that they're like engaged or married or having kids, I'm like, they're still trying to make their life look glamorous, but I mean if that's what you wanna do then I'm more than happy for you, but I can't imagine being twenty with two kids and a husband right now."


This remark revealed how MySpace allows users to present images of themselves as they evolve: "It's just a way to promote yourself to society and show everyone, 'I'm moving up in the world, I've grown, I've changed a lot since high school.' "


The site is also a way to present a side of someone that perhaps few see: "I mean obviously some people wouldn't want to go to school and like flex their muscles in front of everybody but it's like, 'Hey if you check out my MySpace, I'll show you the real cool side of me.' "


And while some may use the site to craft a different personality, it’s not always believable:


"They're trying to look all hard, and they've got pictures of them with guns and drugs and stupid stuff ... they're trying to portray that they're this gangster hard type. I know these people and it's like, that is not who that person is."

Justin Timberlake Releases New Track "Follow My Lead" On MySpace

New York, NY (AHN) - Justin Timberlake has released a new track "Follow My Lead," exclusively on his official MySpace page. The singer teamed up with Dutch singer and songwriter Esmée Denters for a duet that can be downloaded from the music site.

The revenue of "Follow my Lead" will be donated to a chain of Shriners Hospitals for Children, which provides free care to children with various life threatening conditions.

The duet was recorded live at Sexy Back singer's recent Justin Timberlake and Friends Shriners benefit concert. The concert brought together 50 Cent, Adam Levine of Maroon 5, Boyz II Men, Leona Lewis, Lionel Richie, Rihanna, The Jonas Brothers and Will.i.am.

The tune is currently available for purchase for 99 cents, but MySpace Music users can also add it to their playlist for free.


New Xbox Experiences Launches To Great Deal Of Praise

Singer-songwriter believes in hard work

It happens almost every time Ingrid Michaelson does an interview. Journalists ask how her MySpace page led to a publishing deal. About the Googling frenzy that occurred when four of her songs were placed on the hit television series "Grey's Anatomy."

"I can't say I'm upset about it," says Michaelson, who appears Monday at Club Cafe, South Side. "As long as fans like my music, publications can keep writing about me in terms of the business."

It is hard to complain about print features in Rolling Stone, Billboard and Glamour magazines, let alone the placement of a song, "The Way I Am," in an Old Navy campaign. But it seems that short shrift has been given to the music itself, which is shame. Michaelson is a literate, often humorous, songwriter -- "I'll buy you Rogaine when you start losing all your hair," she sings in "The Way I Am" -- and a talented singer.

Call it luck or fate, but Michaelson was in the right place at the right time to take advantage of the opportunities presented to her. And while she's been referred to as the poster girl for success on MySpace, she hasn't exactly invented this path to recognition.

"It's not like I discovered this," Michaelson says. "I always tell people that even if you are offered a lot of opportunities, you can't sit back. You have to really work hard."

And, she might add, you have to take chances. Michaelson admits when she began writing songs, she thought she had to fit into the stereotypical singer-songwriter mode, writing love and loss and heartbreak and all the other things that have consumed musicians since the guitar was invented.

Then, the Staten Island native discovered the music of Magnetic Fields and Death Cab for Cutie.

"I realized I could write anything," Michaelson says of the songs on her album "Boys and Girls." "I can write what my brain is thinking. I don't have to conform to some sort of model. I just started writing what was in my head."

A new album, "Be OK," shows a different side of Michaelson. The songs are quieter, more intimate.

"It's not a fully produced, full-length record," she says. "That's why it's softer."

"Be OK" is also a musical Valentine, of sorts, for fans. Michaelson included a version of "Somewhere Over the Rainbow," a staple of her live shows, and live versions of three other songs that are fan favorites. A portion of the proceeds from the album are donated to Stand Up to Cancer (www.standup2cancer.org), a nonprofit organization founded by the Entertainment Industry Foundation.

Clearly, Michaelson's profile is ascending ... except in her worldview.

"I don't feel like a superstar," she says. "It's not like I have it made. I'm still driving around in a van, and it's not that glamorous. There are times I can't believe some of the things that have happened, like getting on the cover of Billboard. For the most part, that stuff comes in waves. You still have to go out and work."

Teenagers’ Internet Socializing Not a Bad Thing

Good news for worried parents: All those hours their teenagers spend socializing on the Internet are not a bad thing, according to a new study by the MacArthur Foundation.

“It may look as though kids are wasting a lot of time hanging out with new media, whether it’s on MySpace or sending instant messages,” said Mizuko Ito, lead researcher on the study, “Living and Learning With New Media.” “But their participation is giving them the technological skills and literacy they need to succeed in the contemporary world. They’re learning how to get along with others, how to manage a public identity, how to create a home page.”

The study, conducted from 2005 to last summer, describes new-media usage but does not measure its effects.

“It certainly rings true that new media are inextricably woven into young people’s lives,” said Vicki Rideout, vice president of the Kaiser Family Foundation and director of its program for the study of media and health. “Ethnographic studies like this are good at describing how young people fit social media into their lives. What they can’t do is document effects. This highlights the need for larger, nationally representative studies.”

Ms. Ito, a research scientist in the department of informatics at the University of California, Irvine, said that some parental concern about the dangers of Internet socializing might result from a misperception.

“Those concerns about predators and stranger danger have been overblown,” she said. “There’s been some confusion about what kids are actually doing online. Mostly, they’re socializing with their friends, people they’ve met at school or camp or sports.”

The study, part of a $50 million project on digital and media learning, used several teams of researchers to interview more than 800 young people and their parents and to observe teenagers online for more than 5,000 hours. Because of the adult sense that socializing on the Internet is a waste of time, the study said, teenagers reported many rules and restrictions on their electronic hanging out, but most found ways to work around such barriers that let them stay in touch with their friends steadily throughout the day.

“Teens usually have a ‘full-time intimate community’ with whom they communicate in an always-on mode via mobile phones and instant messaging,” the study said.

This is not news to a cluster of Bronx teenagers, gathered after school on Wednesday to tell a reporter about their social routines. All of them used MySpace and instant messaging to stay in touch with a dozen or two of their closest friends every evening. “As soon as I get home, I turn on my computer,” said a 15-year-old boy who started his MySpace page four years ago. “My MySpace is always on, and when I get a message on MySpace, it sends a text message to my phone. It’s not an obsession; it’s a necessity.” (School rules did not permit using students’ names without written parental permission, which could not be immediately obtained.)

Only one student, a 14-year-old girl, had ever opted out — and she lasted only a week.

“It didn’t work,” she said. “You become addicted. You can’t live without it.”

In a situation familiar to many parents, the study describes two 17-year-olds, dating for more than a year, who wake up and log on to their computers between taking showers and doing their hair, talk on their cellphones as they travel to school, exchange text messages through the school day, then get together after school to do homework — during which time they also play a video game — talk on the phone during the evening, perhaps ending the night with a text-messaged “I love you.”

Teenagers also use new media to explore new romantic relationships, through interactions casual enough to ensure no loss of face if the other party is not interested.

The study describes two early Facebook messages, or “wall posts,” by teenagers who eventually started dating. First, the girl posted a message saying, “hey ... hm. wut to say? iono lol/well I left you a comment ... u sud feel SPECIAL haha.” (Translation: Hmm ... what to say? I don’t know. Laugh out loud. Well I left you a comment ... You should feel special.)

A day later, the boy replied, “hello there ... umm I don’t know what to say, but at least I wrote something ...”

While online socializing is ubiquitous, many young people move on to a period of tinkering and exploration, as they look for information online, customize games or experiment with digital media production, the study found.

For example, a Brooklyn teenager did a Google image search to look at a video card and find out where in a computer such cards are, then installed his own.

What the study calls “geeking out” is the most intense Internet use, in which young people delve deeply into a particular area of interest, often through a connection to an online interest group.

“New media allow for a degree of freedom and autonomy for youth that is less apparent in a classroom setting,” the study said. “Youth respect one another’s authority online, and they are often more motivated to learn from peers than from adults.”

GUNS N' ROSES: Entire 'Chinese Democracy' Album To Be Streamed On MySpace - Nov. 19, 2008

GUNS N' ROSES' new album, "Chinese Democracy", will be available for streaming in its entirety on the band's official MySpace page starting tomorrow, Thursday, November 20 until the LP's release date, November 23.

Dutch retailer vanLeest has posted 30-second samples of all the tracks that appear on "Chinese Democracy". Check them out at this location.

The song "Better" off "Chinese Democracy" received its world premier Monday morning (November 17) on a number of U.S. stations, including Q104.3 FM, which is currently streaming the track at this location.

"Chinese Democracy" will be released in the U.S. exclusively through Best Buy. The 14-song set will be available on CD, vinyl, and as a download. While singer Axl Rose has remained silent, co-managers Irving Azoff and Andy Gould said in a statement, "The release of 'Chinese Democracy' marks a historic moment in rock n'roll. Employers Use MySpace, Facebook to Screen Applicants

Employers searching these sites may be a common practice, but it's a risky one.

Popular social network sites like Facebook and MySpace are attracting more than just friends looking to keep in touch.

A survey by the Ponemon institute found 25% of employers are using these sites as a background check. In about 30% of cases they claim what they've found effected their decision.

18-year-old Melanie Young has both a MySpace and a Facebook page. "I have friends everywhere. I like keeping in touch with them," she says.

That's why the Dallas college student uses the social networking sites to share stories and pictures.

But Melanie's friends might not be the only ones surfing her site.

Dallas-based Ryan and Company admits they've used these sites before to screen job applicants.

"When an individual gets to that point where they're looking for a position they need to realize that facebook becomes an extension of your resume," claims Chief HR Officer Delta Emerson of Ryan and Company.

Attorney Clint David says, "A lot of things that people are putting up on their site ranks way up on the stupid meter."

David says employers searching these sites may be a common practice, but it's a risky one.

"You will have access to information on somebody's webpage that is very personal things like religion, sexual orientation, a medical condition. If you do not hire that person, they can come and say that you didn't hire Ihem because of those reasons."

And while he suggests employers use caution, Melanie Young says she plans to do the same.
"Obviously the ones with me drinking or not being so conservative, are the ones I probably would take down."

While both MySpace and Facebook have privacy settings, employers say that doesn't necessarily keep people you don't want on your site off of it.

Dallas Austin Blasts 'ATL Housewife' on MySpace


Super duper record producer Dallas Austin is lashing out at the "The Real Housewives of Atlanta" star on his MySpace page after Kim announced he was helping her with an upcoming album. Austin's newest blog screams, "We are not doing a song, we are not doing an album ... that was only for television!"

Austin made several appearances on the show -- he was even shown working with Kim in a record studio. But after last night's finale when Austin stressed to Kim the importance of getting her voice properly conditioned before she could become a professional singer, it looks like the so-called album is off.

In related news, Lisa Wu Hartwell from "Housewives" is the latest to speak out in her ongoing post-season feud with cast member Kim Zolciak.

Last we heard, Lisa left a threatening voicemail on Kim's cell phone regarding some drama that jumped off between the two of them at the reunion show. Lisa said in the message, "I am not the one -- you need to call me. I might just be coming to your house."

Kim responded by giving an interview alongside her lawyer to TMZ.com, warning of a lawsuit should Lisa make good on her threats.

Over the weekend, TMZ reported that Lisa is all fired up because Kim called her a "crack whore" behind her back and insulted her children. The Web site also says that Lisa believes Kim is using the reunion show fallout to extend her 15 minutes of fame, as reported by Eurweb.com.
